Member Conduct: Rules, Regulations, Policies

This page records the member conduct terms of the Fashion Industry Network, the Apparel Search Company's fashion industry community - introduced there, honestly, as a bit boring but worth reading. The network's closure was announced June 21, 2024; the terms below are the record of the rules members agreed to while it operated.

The foundation is responsibility for content. Everything posted - information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials - was the sole responsibility of the person it originated from: the member, not the network, was entirely responsible for all content they uploaded, posted, emailed, transmitted or otherwise made available. The network did not control content posted through its services and did not guarantee its accuracy, integrity or quality, and members were warned they might be exposed to content that was offensive, indecent or objectionable.

The Prohibited Conduct List

Members agreed not to use the services to post content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; to harm minors in any way; to impersonate any person or entity, including a network official, forum leader, guide or host, or misrepresent an affiliation; or to forge headers or manipulate identifiers to disguise the origin of content. Also prohibited: content a member had no right to make available under law or under contractual or fiduciary relationships (inside information and confidential material included); content infringing any patent, trademark, trade secret, copyright or other proprietary rights; and unsolicited advertising - junk mail, spam, chain letters and pyramid schemes.

The list continues with material containing software viruses or code designed to interrupt or limit computer or telecommunications functionality; conduct disrupting the normal flow of dialogue or other users' ability to engage in real-time exchanges; interference with the services, servers or connected networks, including bypassing robot exclusion headers; intentional or unintentional violation of applicable local, state, national or international law (securities regulations named explicitly); material support to organizations designated by the United States government as foreign terrorist organizations; stalking or harassment; and collecting or storing other users' personal data in connection with any of the above.

Screening, Removal and Disclosure

Members acknowledged that the network might or might not pre-screen content, but that it and its designees had the right - not the obligation - in their sole discretion to pre-screen, refuse or remove any content available through the services, including any content violating the terms or otherwise objectionable. Members bore all risks associated with using content, including reliance on its accuracy, completeness or usefulness, and could not rely on content created by or submitted to the network, including message boards and every other part of the services.

Members also consented to the network accessing, preserving and disclosing account information and content when required by law or in a good-faith belief that doing so was reasonably necessary to comply with legal process, enforce the terms, respond to claims that content violated third-party rights, respond to customer-service requests, or protect the rights, property or personal safety of the network, its users and the public. The services included security components protecting digital materials, members could not override or circumvent usage rules embedded in them, and any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided was strictly prohibited.
